Terms of Use
The rules and expectations for using Bestie Collabs.
1. About These Terms
These Terms govern access to and use of the Bestie Collabs website and services. By creating an account or using the Platform you agree to these Terms and the Privacy Policy.
2. Roles and Definitions
- Brand: a seller that offers products and ships free samples to Creators.
- Creator: a content creator that receives samples and publishes content.
- Collab: a Brand-Creator relationship created on the Platform.
- Bestie Fee: 10% of Net Sale on qualifying transactions.
- Creator Commission: per-collab commission agreed in the Platform.
- Net Sale: gross order minus taxes, customer-paid shipping, and discounts.
- Besties: Brands and Creators who perform well together.
3. Accounts and Eligibility
One role per account (Brand or Creator, not both). Users must provide accurate contact information. Creators need a deliverable shipping address. All users must accept these Terms and Privacy Policy.
4. Fees and Payments
Brands pay a 10% Bestie Fee plus agreed Creator Commission on Net Sales. If sales are refunded or charged back, associated fees reverse. Bestie may net against future payouts or charge the Brand's payment method.
5. Samples, Shipping, and Address Quality
Brands must provide free samples and shipping. Creators maintain accurate addresses and agree to post content. Bad addresses incur a "+1 sales" penalty to unlock more samples, which Brands may waive.
6. Creator Participation Rules
New Creators may request up to 3 samples per Brand and 3 Brands simultaneously. Each product needs at least 1 sale to unlock further requests. Creators can post unlimited content but cannot disparage Brands and must comply with FTC disclosure requirements.
7. Content and Intellectual Property
Creators own their content. Brands cannot reuse Creator content without express written permission or in-app approval.
8. Non-Circumvention
Parties who discover or collaborate through Bestie agree not to transact off-Platform for 12 months from first contact or last activity.
9. Ads and Boosting
Brand-funded boosts require mutually agreed commission changes. Bestie-funded boosts allow Creators their full commission at Bestie's expense.
10. Collab Workflow and Unlocks
Bestie matches parties, Brands ship samples, Creators post content. The Platform manages attribution and eligibility.
11. Disputes: Orders, Returns, and Fraud
Refunds reverse fees. Suspected abuse may trigger holds, clawbacks, or termination.
12. Compliance and Prohibited Conduct
Users must follow all applicable laws and avoid illegal, hateful, or infringing content.
13. Messaging and Support
Use in-app messaging for coordination and issue resolution professionally.
14. Privacy

15. Termination
Bestie may suspend or terminate accounts for violations, non-payment, fraud, or circumvention breaches.
16. Changes to the Service or Terms
The Platform or Terms may be updated with material changes posted. Continued use indicates acceptance.
17. Disclaimers and Liability
The Platform is provided as-is. Bestie disclaims warranties and limits direct liability to fees paid within 3 months preceding a claim.
18. Governing Law and Venue
California law governs; San Francisco County courts have exclusive jurisdiction.
